| BOOKING CONDITIONS
A booking between the Owners and the person(s) making the
booking (the Guest(s)), is valid only after the booking
form has been completed and signed, the appropriate deposit
has been paid to the Owners, and the booking has been confirmed
in writing to the Guest(s) by the Owners. Once a booking
has been made, the Guest(s) agrees to abide by the rules
and legislation in reference to the Villa and Windsor Hills
Resort.
By signing the booking form the Guest(s) accept the following
terms and conditions:
RESERVATIONS
A deposit of $250 per week or 20% of total holiday cost
is payable at the time of booking unless the booking is
made within 10 weeks of departure when full payment is required.
(Where the booking has been made by telephone or e-mail,
the booking will be held for 4 days only.) Confirmation
of your booking along with an invoice for the balance, if
applicable, will be sent by return. The balance of the rental
charge, any pre-¬booked extras (based upon the rental
rates set out in the information brochure) and security
deposit are payable no less than 10 weeks prior to the date
of commencement of the rental period.
CANCELLATION POLICY
This agreement shall terminate on the happening of any one
of the following events:
a) The Guest(s) failing to pay the balance within the time
stated above
b) The Villa, through no fault of the Owners becoming unfit
for the purpose of letting as a holiday home prior to the
commencement date.
In the event of termination under condition (a) above,
the deposit shall be forfeited
In the event of termination under condition (b) hereof,
the deposit and any other monies paid by the Guest(s) to
the Owners will be refunded to the Guest(s) in full without
interest. While the Owners shall use their best endeavors
to find alternative accommodation of similar standard to
the Villa they shall not be liable to the Guest(s) in damages
in the event of being unable to do so, or should such alternative
shall only be available at extra cost to the Guest(s) in
which case the Guest(s) shall be responsible for any additional
charge.
In all instances, cancellations will only be effected once
confirmed in writing. Verbal or telephone cancellations
cannot be honoured until written confirmation has been received.
We will gladly provide proof of payment for a booking for
the purpose of an insurance claim.
SECURITY DEPOSIT
Credit card details are requested as security against loss/damage.
No payment will be taken from the card unless we are advised
by our Management Co. that loss/damage has occurred. Guests
shall be held liable for the cost, without limit, of making
good any and all damage or loss to the Villa, its furnishings
or contents (including excessive use of the phone or utilities
and/or leaving the villa in such condition that warrants
extra cleaning), occasioned during the rental period.
PAYMENT METHODS
Either Personal Cheque or Bankers Draft can make normal
payment. Bankers Draft can only make late bookings. Please
cross all cheques ‘account payee only’ and payable
to: GRAEME SILVESTER
USE OF THE VILLA
Only the persons named on the booking form are allowed to
use the Villa and the facilities at Windsor Hills Resort
(this is a requirement of Florida State Law). No all male
or all female parties will be accepted. We would like to
advise Guests that this is strictly a NO SMOKING
Villa, and are sorry but NO PETS allowed.
CHECK IN/OUT TIMES
The rental commences at 4.00PM on the day of arrival. The
Villa will be cleaned before your arrival and again on your
departure, should you require any further cleans during
your stay please contact our local management company who
will be happy to assist. All rentals are inclusive of electricity,
water and local sales taxes. Telephones are available for
your use in the Villa though registration with a Credit
Card is required to activate the service. For long distance
or international calls it is cheapest to use a pre-paid
phone card.
The Villa must be vacated by 10.00AM on the day of your
departure. Late checkout will be charged at $40 per hour
until 4.00PM. After 4.00PM a full night will be charged
(subject to availability).
SAFETY
Whilst in occupation of the Villa the Guest(s) shall observe
the following:
a) No children under the age of 18 shall be in the Villa
or the pool/jacuzzi area unless supervised by an adult aged
18 years or more.
b) No glassware or other breakable utensil to be taken into
the pool/jacuzzi area.
c) No running, diving or jumping in the pool/jacuzzi area.
d) Not to touch or interfere with the pool filtration equipment
or the lawn sprinkler system control equipment.
e) Not to use a BBQ within the lanai (i.e. screened pool
area), or in any other location within the Villa itself.
POOL & JACUZZI HEAT
Please note if you have ordered pool/jacuzzi heat temperatures
cannot be guaranteed and are subject to prevailing weather
conditions. The heater is only turned on when payment has
been received. If pool/jacuzzi heat is requested following
Guest arrival at the Villa only full weeks payment and not
pro-rata days will be accepted. Please also be aware that
it may take 2/3 days for the pool to heat up properly. In
the event of pool heater breakdown or other circumstances
beyond our control the Owners / Owner’s Agent will
do their best to rectify the problem ASAP. In such an event
liability will be limited to refunding the pool heat money
paid by the Guest for the number of days that the heater
is out of action only – no other compensation will
be paid.
LIABILITY LIMITATIONS
Neither the Owners nor the Owner’s Agent accept any
responsibility or liability whatsoever for any of the following:
1. Loss, theft, damage or destruction of luggage or personal
possessions at any time in or about the Villa or in any
location in the USA.
2. Damage or destruction of personal possessions through
regular or improper use of any villa utilities.
3. Any and all injuries to occupants, family members, or
guests occurring on or about the Villa.
4. Any delay, disruption or changes to Guests vacation caused
by force major events (e.g. strikes, riots, fire, flood,
transport problems of any kind, inclement weather conditions)
or any other event beyond their control.
WE STRONGLY RECOMMEND THAT ALL GUESTS ARRANGE PERSONAL
TRAVEL INSURANCE BEFORE COMMENCING TRAVEL.
